TRADEMARK NOTICE AND POLICY

Introduction

This Trademark Notice and Policy (the "Policy") is issued by Euro Poker Tour Limited ("EPT"), the owner and operator of the series of poker events known as the European Poker Tour (the "Tour").

The Policy sets out the complete terms and conditions under which third parties may use the Terms and the Marks (as such terms are defined below) which have been developed and used by EPT in relation to the Tour.

Purpose

The purpose of the Policy is to protect the commercial value of the Terms and Marks, to prevent the unauthorised use of the Terms and the Marks and to avoid confusion on the part of individuals in respect of the association (or lack thereof) between EPT and/or the Tour and any other poker event, tournament, organization or Internet site.

Definitions

For the purpose of the Policy, the word "Terms" shall mean each of the following:

EPT
European Poker Tour Series 1
European Poker Tour Series 2
European Poker Tour Series 3
PokerStars.com EPT
PokerStars.com European Poker Tour

or any other phrase confusingly similar to the foregoing.

For the purpose of the Policy the word "Marks" shall mean all of the components of the following:

The Terms and Marks are protected by laws of intellectual property such as trademark law, unfair competition and passing off.

Use of the Terms and the Marks

You are permitted and encouraged to use the Terms and/or the Marks for editorial use, such as reporting Tour-related events in news coverage.

You are permitted to use the Terms and/or Marks in association with online poker tournaments (satellite tournaments) solely where the prizes for such tournaments include buy-ins (entrance) for Tour events.

You are not permitted to use the Terms and/or Marks in association with online or offline advertising or promotion of poker, gaming, betting or lottery products or services.

You are not permitted to use the Terms and/or Marks in any manner which would reasonably be understood to suggest any type of association or sponsorship between EPT and/or the Tour on the one hand and any third party trademarks, businesses, goods or services on the other hand.

You are not permitted to use the Terms and/or the Marks for any other purpose unless explicitly provided for herein.

Modification

EPT reserves the right to modify the Policy from time to time.

Warning

EPT shall not tolerate the breach of the Policy by any unauthorised party and it shall spare no effort to use available legal remedies in order to protect its rights in the Terms and the Marks.
